These Terms and Conditions apply to purchases made from Draig Creations through our website, by telephone, email, social media, at markets, fairs, shows and other events, and where applicable through bespoke or direct orders.
Please read these Terms and Conditions carefully before placing an order.
Nothing in these Terms and Conditions affects your statutory rights as a consumer.
1. About Draig Creations
Draig Creations is a family-run laser engraving business based in Wrexham, North Wales.
Our contact details are:
Draig Creations
15 Brynteg Crescent
Brynteg
Wrexham
LL11 6NA
Telephone: +44 (0)7376 600833
Email: draigcreations@gmail.com
We design, engrave and finish products in our own workshop in Wrexham and also operate a mobile engraving workshop at selected shows, markets and events.
Throughout these Terms and Conditions, references to “Draig Creations”, “we”, “us” or “our” mean Draig Creations.
References to “you” or “customer” mean the person purchasing or requesting goods or services from us.
2. Products
We produce and sell a range of laser-engraved and personalised products including products made from:
- wood;
- slate;
- glass;
- metal;
- and other suitable materials.
Our ranges include personalised gifts, homeware, chopping and serving boards, coasters, signs, clocks, licensed merchandise and bespoke engraved products.
Many of our products are individually engraved, hand-finished or made using natural materials.
Because of this, minor differences between individual products are normal.
3. Handmade Products and Natural Materials
Wood, slate and other natural materials naturally vary in colour, grain, texture, thickness, pattern, knots and surface characteristics.
These variations are part of the character of the material and do not normally constitute a fault.
Laser engraving can also vary slightly depending upon the natural properties of the material being engraved.
For example:
- wood grain may cause areas of engraving to appear lighter or darker;
- slate may contain natural edges, markings or variations;
- engraving depth may vary slightly across natural surfaces;
- colours and shades shown in photographs may differ slightly from the physical product;
- dimensions of handmade or natural products may vary slightly from those stated.
We take reasonable care to ensure that products are accurately described and that any variation remains appropriate for the product being supplied.
Nothing in this section affects your rights where a product is faulty, damaged, materially different from its description or otherwise does not meet the requirements of UK consumer law.
4. Product Images
We make reasonable efforts to display our products accurately.
However, photographs are illustrative and factors including lighting, natural materials, computer screens and mobile displays may cause colours or finishes to appear slightly different.
Where a photograph shows a personalised example, the names, dates, wording or other personalisation displayed are examples unless specifically stated otherwise.
Props, stands, decorations or other items shown in photographs are not included unless they are expressly stated to form part of the product.
4.1 AI-Generated Product Representations
Draig Creations may occasionally use an AI-generated product representation or digital product mock-up within a product listing to illustrate the design, layout or intended positioning of an engraving.
This may be particularly useful for products made from natural materials such as wood, where variations in grain, colour, knots, texture and density can cause the appearance and contrast of laser engraving to vary from one item to another.
An AI-generated product representation or digital mock-up is an illustrative representation and is not a photograph of a physically engraved product.
Where an AI-generated product representation is used, this will be clearly identified within the product listing. The product gallery will also contain at least one genuine photograph of an engraved example so that customers can see the appearance and finish that can reasonably be expected from the actual engraving process.
AI-generated representations are not intended to exaggerate or misrepresent the quality, engraving depth, colour, contrast, dimensions, materials or finish of the product. We take reasonable steps to ensure that such representations remain materially consistent with the product that customers can reasonably expect to receive.
Because wood and other natural materials vary naturally, the exact grain, colour, engraving contrast, depth and appearance of the product supplied may differ from the example photographs or digital representations shown.
Natural variations in the material do not themselves constitute a defect. This does not affect your statutory rights where goods are faulty, not of satisfactory quality, not fit for purpose where applicable, or materially different from their description.
5. Personalised and Custom-Made Products
Many Draig Creations products are made or personalised specifically for the customer.
This may include products containing:
- names;
- dates;
- photographs;
- messages;
- logos;
- customer-supplied artwork;
- custom wording;
- bespoke layouts;
- custom dimensions;
- specially requested designs;
- or other individual specifications.
You are responsible for checking that all personalisation information supplied to us is correct.
This includes checking:
- names;
- spelling;
- punctuation;
- dates;
- numbers;
- wording;
- photographs;
- layout instructions;
- and any other information supplied for engraving.
Where we reproduce information exactly as supplied by you, we are not responsible for an error contained in the information you provided.
If you notice an error after placing your order, contact us immediately. We will make reasonable efforts to amend the order if production has not already begun.
Once engraving, cutting, design preparation or other production work has begun, it may not be possible to change the order.
6. Design Proofs
A digital proof may be supplied for certain bespoke or personalised orders where we consider one appropriate or where this has been agreed with you.
A proof is intended to show the proposed design, wording and general layout.
Digital proofs do not necessarily represent the exact colour, engraving depth, grain, texture or appearance of the finished material.
Where you are asked to approve a proof, you are responsible for checking it carefully before approval.
Once a proof has been approved and production begins, alterations may incur additional charges or require a replacement product to be made.
If an error appears in the finished item because we failed to follow an approved proof or the agreed instructions, this does not remove any rights you may have in respect of the product.
7. Customer-Supplied Images, Logos and Artwork
If you provide us with an image, photograph, logo, design, wording or other material for reproduction or engraving, you must have the necessary permission or legal right to use that material for the requested purpose.
You must not knowingly ask us to reproduce material that:
- infringes another person’s copyright or trade mark;
- infringes intellectual property rights;
- is unlawful;
- is fraudulent;
- is defamatory;
- or is otherwise prohibited by law.
We may refuse to reproduce any image, wording, logo or design where we reasonably believe that doing so may infringe another person’s rights or may be unlawful.
We may ask for evidence that you are authorised to use a business logo, club badge, copyrighted image or other protected material.
Acceptance of artwork by Draig Creations does not constitute confirmation that the customer owns or has permission to use that artwork.
8. Our Designs and Intellectual Property
Unless otherwise stated, original artwork, illustrations, layouts, graphics, product designs, photographs, branding and other creative material produced by Draig Creations remain the intellectual property of Draig Creations or the relevant rights holder.
Purchasing a physical product does not transfer ownership of the underlying design or intellectual property rights.
Draig Creations designs must not be copied, reproduced, traced, digitised, resold as design files, commercially reproduced or used to manufacture competing products without our prior written permission.
This does not affect any intellectual property belonging to a customer or third-party rights holder.
8.1 Designs, Artwork and Use of AI
Draig Creations may sometimes use artificial intelligence (AI) tools to assist with parts of the creative and design process. This may include exploring ideas and concepts, assisting with layouts, developing design elements or producing material for further editing and refinement.
Where AI is used, it forms part of our wider creative workflow. Designs may subsequently be edited, adapted, redrawn, combined, refined or otherwise modified by Draig Creations before being prepared for engraving or production.
The use of AI assistance does not mean that every Draig Creations product or design is AI-generated. Our products may incorporate original artwork created by Draig Creations, customer-supplied artwork, officially licensed material, commercially licensed design resources, AI-assisted material, or a combination of these.
Where third-party or licensed material is used, ownership of the underlying intellectual property remains with the relevant rights holder.
9. Officially Licensed Merchandise
Draig Creations produces certain merchandise under official licensing arrangements, including officially licensed Wrexham AFC merchandise.
Where a product is described as officially licensed, the relevant names, crests, logos, trade marks and other protected intellectual property remain the property of their respective rights holders.
Purchase of licensed merchandise does not give the customer any right to reproduce, manufacture, copy or commercially exploit the licensed artwork or branding.
Licensed products may only be personalised where permitted under the relevant licence and where the requested personalisation is suitable.
We reserve the right to refuse requests that would breach the terms of an applicable licensing agreement.
10. Bespoke Design Requests
We welcome bespoke and custom engraving requests.
The availability and price of bespoke work depends upon factors including:
- material;
- product size;
- design complexity;
- preparation time;
- engraving time;
- quantity;
- artwork requirements;
- and finishing requirements.
A quotation may be provided before work begins.
Unless otherwise stated, quotations are based on the information available to us at the time they are given.
If the specification changes, we may provide a revised quotation before carrying out additional work.
11. Placing an Order Online
When you place an order through our website, you are making an offer to purchase the products shown in your order.
Receipt of an automated order acknowledgement does not necessarily mean that we have accepted your order.
We may need to check:
- availability;
- personalisation information;
- artwork;
- licensing requirements;
- payment;
- delivery restrictions;
- or other details.
A contract between you and Draig Creations is formed when we accept your order or begin producing your personalised or bespoke product.
For standard non-personalised products, acceptance may occur when we confirm or dispatch the order.
If we cannot accept an order, we will notify you and refund any payment already taken for products we are unable to supply.
12. Orders Made at Shows, Markets and Events
Draig Creations regularly sells products at markets, craft fairs, shows and other events.
Products purchased in person are covered by your statutory consumer rights.
However, purchases made face-to-face do not generally have the same automatic change-of-mind cancellation rights as qualifying distance purchases made online or by telephone.
Personalised products engraved while you wait or ordered specifically for you are custom-made products.
If an item purchased at an event is faulty, damaged or not as described, please contact us and we will deal with the matter in accordance with our Returns & Refund Policy and your statutory rights.
13. Prices
Prices displayed on our website are stated in pounds sterling (£).
The price payable is the price shown or otherwise agreed when you place your order, subject to the correction of obvious errors.
Delivery charges, where applicable, will be shown or communicated before the order is completed.
We may change our prices at any time, but a price change will not normally affect an order that we have already accepted.
If an obvious pricing error occurs, we may contact you before accepting the order and give you the option of continuing at the correct price or cancelling the order.
14. Promotions and Discount Codes
From time to time we may offer:
- promotional discounts;
- voucher codes;
- market offers;
- introductory offers;
- multibuy offers;
- or other promotions.
Unless stated otherwise:
- promotional codes cannot be exchanged for cash;
- only one promotional code may be used per order;
- promotions may have expiry dates;
- promotions may exclude selected products or ranges;
- and licensed merchandise may be excluded from certain promotions.
Any specific terms supplied with a promotion will apply in addition to these Terms and Conditions.
Sale and discounted goods retain the same statutory rights concerning faulty, damaged or misdescribed products as full-price goods.
15. Payment
Payment must be made using one of the payment methods offered at the point of purchase.
Orders may not enter production until payment has been received or otherwise agreed.
For bespoke, wholesale, corporate or larger orders, we may require:
- full payment in advance;
- a deposit;
- or staged payments.
Any such payment arrangement will be confirmed when the order is agreed.
We will never ask customers to provide complete payment-card security information by email.
16. Production and Dispatch Times
We aim to process and dispatch website orders promptly and currently aim to ship many orders within approximately 72 hours.
This is an aim rather than a guaranteed delivery commitment unless a specific date has been expressly agreed with you.
Personalised, bespoke, large-volume or particularly complex orders may require additional production time.
During particularly busy periods, including Christmas, major events or periods of unusually high demand, production times may be longer.
Where a particular date is important, such as a wedding, birthday or other event, please tell us before ordering or as early as possible.
We will not describe a delivery date as guaranteed unless we have expressly agreed that it is guaranteed.
17. Delivery
Available delivery methods and applicable charges will normally be shown during checkout or agreed with you before purchase.
You are responsible for providing a complete and accurate delivery address.
If an order is delayed or returned because an incorrect or incomplete address was supplied, additional delivery charges may apply before the order is resent.
We are not responsible for delays caused by circumstances outside our reasonable control, but this does not affect any statutory rights you may have where goods are not delivered within an agreed or legally required timeframe.
Risk in goods purchased by a consumer normally passes to you when the goods come into your physical possession or the possession of a person identified by you to receive them.
18. Damaged or Missing Deliveries
Please inspect your order when it arrives.
If a parcel arrives damaged, an item is missing or the contents have been damaged during transit, contact us as soon as reasonably possible.
Providing photographs of:
- the product;
- external packaging;
- internal packaging;
- and shipping label
may help us investigate the matter and arrange an appropriate solution more quickly.
Your statutory rights are not dependent upon your ability to provide photographs.
19. Cancellation Rights for Non-Personalised Distance Orders
Where you are a consumer purchasing a standard, non-personalised product online, by telephone or through another qualifying distance-selling method, you may have the legal right to cancel your order without giving a reason.
Where the statutory right to cancel applies, the normal cancellation period is 14 days beginning on the day after you receive the goods.
Please refer to our Returns & Refund Policy for full information about:
- cancelling an order;
- returning goods;
- return costs;
- refunds;
- and applicable timescales.
Nothing in these Terms restricts your statutory cancellation rights.
20. Personalised Goods and Change-of-Mind Cancellations
The statutory change-of-mind cancellation right applicable to many distance purchases does not generally apply to goods that are made to the customer’s specifications or clearly personalised.
This means that once production has begun on a personalised or custom-made item, we are normally unable to accept a cancellation simply because you have changed your mind.
This includes products made specifically using your:
- name;
- date;
- wording;
- photograph;
- dimensions;
- logo;
- bespoke design;
- or other individual specification.
Where you request cancellation before work has begun, we will consider the request and, where possible, cancel the order and issue a refund.
Once design preparation, engraving, cutting or other production work has begun on a personalised or custom-made product, we may be unable to accept a change-of-mind cancellation. Where we agree to a cancellation after work has begun, any refund will take account of work already carried out and materials already used, to the extent permitted by law.
This does not affect your rights if a personalised product is faulty, damaged, not as described or has been made incorrectly by us.
21. Returns, Refunds, Repairs and Replacements
Our detailed rules regarding returns, refunds, repairs and replacements are contained in our Returns & Refund Policy.
That policy forms part of these Terms and Conditions.
In particular, nothing in these Terms affects your rights under applicable UK consumer legislation.
Goods supplied to consumers must meet the legal requirements applicable to them, including being of satisfactory quality, fit for any purpose made known where applicable, and as described.
22. Product Care
Customers should follow any care instructions supplied with a product or displayed on the relevant product page.
Different materials require different care.
Unless expressly stated otherwise, products should not be exposed to conditions that are inappropriate for the material from which they are manufactured.
Damage caused by misuse, inappropriate cleaning, accidental damage, neglect or failure to follow reasonable care instructions is not normally considered a manufacturing fault.
This does not affect your statutory rights where the product itself is defective.
23. Customer-Supplied Items for Engraving
We may occasionally agree to engrave an item supplied by the customer.
Because laser engraving permanently alters a product, customer-supplied items are accepted for engraving only by prior agreement.
We will take reasonable care when handling customer property.
However, different materials, coatings and manufacturing processes may react differently to laser engraving.
Where appropriate, we may recommend testing or may refuse an item if we believe it is unsuitable for safe or reliable engraving.
Any specific risks associated with engraving a customer-supplied item should be agreed before work begins.
Nothing in this section excludes liability that cannot lawfully be excluded.
24. Refusal of Orders
We may refuse an order where we have a reasonable reason for doing so, including where:
- the requested product is unavailable;
- payment cannot be authorised;
- the supplied information is incomplete;
- the requested work appears unlawful;
- the requested design may infringe intellectual property rights;
- the request conflicts with a licensing agreement;
- the material is unsuitable for engraving;
- fulfilling the order would create an unreasonable safety risk;
- or an obvious pricing or website error has occurred before the order has been accepted.
If we decline an order after receiving payment and no goods or chargeable work have been supplied, the appropriate payment will be refunded.
25. Wholesale, Corporate and Business Orders
We welcome orders from businesses, retailers, charities, organisations and other commercial customers.
Separate quotations, wholesale price lists, supply agreements or written terms may apply to business orders.
Where specific written terms are agreed for a wholesale, corporate or business order, those terms will take precedence over these general Terms and Conditions to the extent of any conflict.
Consumer cancellation rights do not apply to purchases made wholly or mainly for business purposes.
Nothing in these Terms is intended to give a business customer consumer rights that do not legally apply to that transaction.
26. Stockists and Third-Party Retailers
Selected Draig Creations products may be available from authorised stockists or other retailers.
Product ranges, prices and availability may vary between locations.
If you purchase a Draig Creations product directly from another retailer, your contract of sale is normally with that retailer.
Your statutory rights remain unaffected.
Officially licensed or exclusive products may only be available from selected outlets.
27. Third-Party Marketplaces
Draig Creations products may also be offered through third-party marketplaces or selling platforms.
Where you purchase through a third-party platform, that platform’s applicable terms and procedures may also form part of the transaction.
Nothing in a third-party platform’s terms removes any statutory rights you have against Draig Creations where Draig Creations is the seller of the goods.
28. Website Availability
We make reasonable efforts to keep our website available and accurate.
We cannot guarantee that the website will always operate without interruption or technical errors.
We may temporarily suspend, alter or update areas of the website where reasonably necessary for maintenance, security or improvement.
We may also correct typographical errors, product information, availability information or pricing errors when identified.
29. Website Use
You must not knowingly:
- introduce viruses or malicious software;
- attempt unauthorised access to the website or systems connected to it;
- use the website for unlawful purposes;
- interfere with the normal operation or security of the website;
- fraudulently place orders;
- or reproduce protected website content for commercial purposes without permission.
30. Personal Information and Privacy
Personal information supplied to Draig Creations is handled in accordance with our Privacy Policy and applicable data-protection law.
Please refer to our Privacy Policy for further information about how we collect, use and protect personal information.
31. Liability
Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- or any statutory consumer right that cannot legally be excluded or restricted.
If you are purchasing as a consumer, we are responsible for losses that are a foreseeable consequence of our breach of contract or failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
We are not responsible for business losses suffered by a consumer, including loss of profit, loss of business, business interruption or loss of business opportunity, where the product was purchased wholly or mainly for personal use.
Different provisions may apply to orders placed wholly for business purposes and these may be specified in an individual quotation or business agreement.
32. Events Outside Our Reasonable Control
We will not be responsible for delay or failure to perform an obligation where this results from circumstances outside our reasonable control.
Examples may include:
- severe weather;
- postal or courier disruption;
- fire or flood;
- power failure;
- major equipment failure;
- transport disruption;
- industrial action;
- government restrictions;
- or other events that could not reasonably have been prevented.
Where such an event affects an order, we will take reasonable steps to minimise disruption and will contact affected customers where appropriate.
Your statutory rights concerning delayed or undelivered goods remain unaffected.
33. Complaints
We take pride in the products we produce and want customers to contact us if something is wrong.
If you have a complaint about a product or order, please contact:
Email: draigcreations@gmail.com
Telephone: +44 (0)7376 600833
Please provide your name, order details and a description of the problem.
Where relevant, photographs may help us investigate the issue.
We will aim to deal with complaints fairly and within a reasonable period.
34. Governing Law
These Terms and Conditions and contracts between you and Draig Creations are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you may also benefit from mandatory protections provided by the law applicable where you live.
Any dispute will be dealt with by the courts that have jurisdiction under applicable law.
35. Severability
If any part of these Terms and Conditions is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
36. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes to:
- our products or services;
- our business operations;
- our website;
- applicable legislation;
- or regulatory requirements.
The version applying to an order will normally be the version in force when the order was placed.
The latest version will be published on our website together with the date it was last updated.
37. Other Policies
These Terms and Conditions should be read together with the other relevant policies published on our website, including our:
- Returns & Refund Policy;
- Privacy Policy;
- delivery information;
- product-specific information;
- care instructions;
- and any additional terms supplied for bespoke, wholesale or corporate orders.
If there is a conflict between these Terms and a mandatory right provided by law, the legal right will apply.
38. Your Statutory Rights
Nothing in these Terms and Conditions is intended to exclude, restrict or replace any statutory rights available to you under UK law.
This includes rights that may arise under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 where applicable, the Digital Markets, Competition and Consumers Act 2024, and any other applicable consumer legislation.
Where there is any conflict between these Terms and your statutory rights, your statutory rights will apply.
